Terms of Service

By accessing or using the School Tag platform, administrative dashboard, mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are accepting these Terms on behalf of a school, district, or other educational institution, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you may not access or use the Service.

School Tag is a K-12 school safety and operations platform developed and operated by Alpha Heights LLC ("Company," "we," "us," or "our"). The Service provides:

• QR-code-based student attendance, dismissal, and bus-boarding tracking.
• Secure parent notification and dismissal authorization workflows.
• Emergency broadcast and real-time emergency response communications (eRC).
• Administrative dashboards for school and district administrators.
• A discipline management system (DMS) for authorized staff.
• Clever SSO integration for district-managed single sign-on.

Features may vary by subscription tier and region. We reserve the right to modify, suspend, or discontinue any portion of the Service with reasonable notice.

• You must be at least 18 years old and authorized by your institution to create an account.
• School Tag accounts are intended for educational institution staff and authorized administrators. Parent accounts are created at the direction of the school.
• You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
• You must promptly notify us of any unauthorized use of your account at support@myschooltag.com.
• We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

You agree to use the Service only for lawful educational purposes. You must not:

• Process data of individuals outside your school or district without explicit authorization.
• Reverse engineer, decompile, or extract source code from any part of the Service.
• Upload malicious code, attempt unauthorized access, or disrupt the Service's infrastructure.
• Resell, sublicense, or otherwise commercialize access to the Service without written consent.
• Use student data for advertising, profiling, or any purpose inconsistent with educational operations.
• Misrepresent your identity or institutional affiliation when registering or using the Service.

When using School Tag to process student data, the educational institution acts as the data controller and School Tag acts as a data processor on its behalf. Institutions are responsible for:

• Obtaining all required parental consent under FERPA, COPPA, and applicable state or provincial law before enrolling students in the Service.
• Ensuring that only authorized staff are granted administrator or teacher-level access.
• Providing accurate and up-to-date student roster information.
• Establishing and enforcing appropriate internal policies for QR code use, device management, and emergency procedures.
• Promptly notifying School Tag of any data breaches or security incidents that may affect Service data.

School Tag sends transactional SMS notifications to parents and guardians on behalf of schools. By providing a mobile number and consenting to receive messages, you agree to receive text messages related to student dismissal, safety alerts, and account activity. You may opt out at any time by:

• Replying STOP to any message.
• Contacting your school administrator to update notification preferences.
• Adjusting settings in your account profile.

Message and data rates may apply. Frequency varies based on school activity and safety events. Our SMS practices comply with TCPA requirements and carrier guidelines.

• Subscription Plans: Access to paid features requires an active subscription. Plans, pricing, and included features are described on the School Tag website or in your order form.
• Billing: Fees are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law or expressly stated in your agreement.
• Taxes: You are responsible for all applicable taxes, levies, or duties assessed on your subscription.
• Upgrades & Downgrades: You may change your plan at any time. Upgrades are effective immediately; downgrades take effect at the next billing cycle.
• Non-payment: Failure to pay may result in suspension or termination of access after reasonable notice.

The Service, including its software, design, content, and trademarks, is the exclusive property of Alpha Heights LLC and its licensors, protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all data and content you upload. By uploading data, you grant Alpha Heights LLC a limited, non-exclusive, worldwide license to store, process, and display it solely to provide the Service to you. We do not claim ownership over your institutional data or student records.

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding uptime, fitness for a particular purpose, or the accuracy of any data generated by the Service.

School safety decisions remain with trained staff. School Tag supports emergency communications but does not replace the judgment of administrators, security personnel, or emergency responders. We are not liable for outcomes of safety decisions made using information from the Service.

To the maximum extent permitted by law, Alpha Heights LLC's total liability for any claims arising from these Terms or the Service shall not exceed the greater of (a) the fees paid by you in the 12 months preceding the claim or (b) $100 USD. We are not liable for indirect, incidental, consequential, or punitive damages.

Either party may terminate the agreement with 30 days' written notice. We may terminate immediately for material breach, non-payment, or conduct that poses a risk to other users or the integrity of the Service.

Upon termination, your access to the Service ends immediately. We will securely destroy your institutional and student data within 30 days, unless a longer retention period is required by law or your data agreement.

We may update these Terms from time to time. When we do, we will revise the effective date above and notify account administrators by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you may terminate your subscription before the new effective date.
